Your Excellency,

Robbery with violence or armed robbery. These

cases have assured and are still assuming a very serious form. Heavy sentences, together with whipping which I imposed frequently when acting as Chief Justice, are being regularly given, but I understand that the nature of the whipping has little, if any, deterrent effect. The conditions relating to flogging are laid down in Ordinance 3 of 1903 which require the flogging to be

inflicted with the bixk birch on the breech", and in the case of

an adult is limited to twenty-four strokes, and in that of an

offender under sixteen to twelve strokes.

On visiting the prison yesterday I was informed

by Mr. Craig, Deputy Superintendent, that flogging win the birch

has no real effect on this class of criminals, and he also told me

that the "cat" was imposed for breach of Prison Regulations. I txix) think the question probably properly arises whether extreme measures are not necessary to cope with the present state of affairs as these miscreants often in broad daylight and sometimes it in frequented places gag and muzzle not only men but women andr children and rob them of all their belongings, and I see no reason why the mode of punishment meted out toppressors for breach of Prison Regulations should not properly be given for crimes of violence of this description, which in point of number and audacity exceed anything within my twenty-three years experience

in the Criminal Courts.

Having regard to the view which you have expressed and the conditions now prevailing Your Excellency may thinkit desirable to obtain the Secretary of State's sanction to amend Ordinance 3 of 1903, so as to empower the Court in such cases to specify in its sentence the instrument to be used and the number of strokes to be inflicted as is provided for in the

t Imperial Act 26 and 27 Vict. Cap. 44, (Garrothers Act 1863).
